I have had one professional financial advisor state that the IRS may not allow the expoenses of an unapproved FDA ADR( multi-level) to be deducted from my income taxes . For those of you who have paid for the ADR's yourself , have you been successful in deducting these costs ?

Successful? To what extent? I just filed mine, got my refund and I guess will have to wait a few years to see if audited. I looked thru the pertinent sections of the tax code and followed it and saw no reason I couldn't do it. Others have done it also that I have spoken to.

Check with tax specialist who is familiar with the code, many prof. advisors are not. Good luck and let us know if you come to any conclusions. I will let you know if UNCLE SAM comes knockin on my door.

On what basis would spine surgery not be considered a legitimate medical expense?

There are off-label uses of medical products all the time and I've never heard of them being disallowed by the IRS.

I deducted my surgery in 2002.

Thomas, take your medical deductions. Worst case scenario it would be denied if you are audited, but I'll bet money there is no problem. All the IRS needs to know it was spine surgery.

We deducted my wife's surgery, travel costs, my travel costs and anything remotely associated all with the blessing of our CPA.

My tax advisor could find no reason why I couldn't claim this as a medical expense on my taxes (here in the US or abroad)(plus travel costs). I filed and have my return which reflects my medical costs over the past year.
