I thought I would give you guys a little background on me so you know where I am coming from. I am not telling you these things to boast but so you have an understanding of my pain tolerance and abilites pre-injury. Prior to being injured I was California State Champion Adventure Racer. Four monhts before the injury I completed a race that took 24 hours 30 minutes non-stop through the moauntains. This included 12 hours of mountain biking up extreme elevations, 7 hours of kayacking down a river, and 5 hours of running through the mountains including swimming the american river at 4:30 a.m. , all nonstop by map and compass in 100 degrees, without sleep and carrying all my equipment on my body food, water, supplies. For reference these races are often on the discovery channel. I also was a triathlete and won many road and mountain races. I was a waterskiier including barefoot, slalom, and trick. During my competetions I have raced through heat exhaustion, ran for hours with blisters on my feet that I duct taped, road my bike for two hours after embedding rocks and gravel deep into the muscles of my arm nd abdomen then drove myself to the E.R. I severed my anterior curciate ligament at 17 years old and was told I needed immediate reconstrucion. I got off the exam table and played my senior year of basketball on no pain meds after the doctor said it was impossible. Three days later, after the season, I had a cadaver ligament transplant screwed into my knee with three bolts that still exist today. Anyway I have always had a problem recognizing pain since I was a child. For the docotrs to compare me to anyone else is unfair, my level of function can only be compared to who I was before.

Jenny, thx for sharing that last post. I am blown away with your athletic prowess. I hope you can exploit your competitive & strong mind to help you win this latest round of challenges!

And that should all be part of what the WC judge is given as information on the why part re the continuing training while on pain medication etc.

Awesome stuff Jenny~ I've been very active in my past before all the injury and screwed up surgical results tho nothing nothing nothing (nothing infinity)on that scale!

Thanks Mariaa and Harrison,
Please know that I did not list my athletic endeavors to boast but to explain what my conditioning and competitive drive was prior to surgery. For info. I just put my web site in my profile. If you look at the bottom MRI where you can see the large anterior herniation of L4-L5, HIZ sign of a serious anular tear in L3-4, beginning modic changes in the vertebral bodies and desciation of L3 to L5. This was taken 8 months after my injury, the first set of films including X-rays taken after I was jumped and I had continued working full time on the street wearing 30 lbs of equipment on my body, getting in additonal altercations etc. After this was taken I was told the MRI was negative, no herniations etc. that I had a lumbar strain. I continued working full time for 8 more months until I was in another altercation which left me with leg pain and I was finally sent to a specialist.

Jenny, I think that the list of your althletic endevors are great ammo for your case. After veiwing your films, tihis is even more unreal. As Maria said, "i cant see judge of any type putting this through. I will Pm you with some other ideas. Dano

The mentality of employers and doctors of -- "your on medication so nothing is wrong and you are functioning ok" OK for who? Not the person with the disability. It sure wouldn't hurt to contact Arnold's office and give him some bad publicity on how messed up the WC system has become, thanks in part to him. If there's anything I can do to help, please let me know.

I thought what was being discussed here was criminal charges, not the worker's comp. side of case? Two different things. State would have to bring forth the criminal charges? I would assume Jenny is more worried about those charges at this point than the WC portion of her case.

How are you fighting those charges? Has your WC attorney set you up with a good criminal law attorney?

Yes, you are right. Yes I have good attourney's for both. Yes they (W/C and state) have joined together in communication.

What crime can they possibly charge her for? "Fraud" to get money in order to have hardware put in her back?? Does anyone really believe this would fly, in any court??

The state would not bring charges if they had nothing. They must have something they feel they can hang hat on. Whether its going to stand is another story. But yes, she indicated earlier it she was charged with 15 counts or so of insurance fraud.
